STANDARD TERMS AND CONDITIONS OF SALE
General Provisions
- These Terms and Conditions apply to all professional services provided by Okapi Migration Services.
- By engaging our services, the client acknowledges and agrees to these Terms and Conditions.
- Any variation to these Terms must be agreed upon in writing by Okapi Migration Services.
Payment Terms
- The payment due date varies depending on the service provided. The client must adhere to the due date stated on the invoice.
- If payment is not received by the due date, Okapi Migration Services reserves the right to charge interest at a rate of 10% per annum on the outstanding amount.
- If payment remains overdue for more than 60 days, Okapi Migration Services may engage a debt recovery agency or initiate legal proceedings. The client will be responsible for all associated costs, including legal and collection fees.
Withholding Taxes
- If the client is subject to withholding tax under local tax laws, such tax shall be borne solely by the client.
- The full invoiced amount remains payable to Okapi Migration Services, and the client must ensure that payments are made in full without deductions for any local tax obligations.
Provision of Services
- Okapi Migration Services will use its best efforts to provide services in a timely and professional manner.
- While we strive for successful outcomes, our services do not constitute a guarantee of a visa grant or other migration outcome, as final decisions are at the discretion of the Department of Home Affairs or other relevant authorities.
- Okapi Migration Services is not liable for delays caused by external factors, including government processing times or client delays in providing required documentation.
Suspension or Termination of Services
- Okapi Migration Services reserves the right to suspend or terminate services if the client fails to comply with payment obligations or acts in a manner that breaches our professional or ethical standards.
- Any prepaid fees for services already rendered will be non-refundable.
Limitation of Liability
- Okapi Migration Services is not responsible for any loss, damages, or consequences arising from the client’s failure to provide accurate or complete information.
- We will not be liable for indirect or consequential losses, including but not limited to lost business opportunities, delays, or reputational damage.
Client Responsibilities
- The client must provide accurate and truthful information for migration matters and promptly supply all required documents.
- Failure to do so may result in delays, additional costs, or adverse visa outcomes, for which Okapi Migration Services shall bear no liability.
Complaints and Disputes
- Any concerns regarding the services provided must be raised in writing within 8 days of service delivery.
- Disputes will first be addressed through negotiation and, if necessary, mediation before legal action is pursued.
Governing Law and Jurisdiction
- These Terms and all engagements with Okapi Migration Services shall be governed by and interpreted in accordance with the laws of Australia.
- Any legal disputes shall be subject to the exclusive jurisdiction of Australian courts.
