OKAPI DIGITAL PRODUCT TERMS

1. Seller and scope
These Digital Product Terms govern orders for digital resources supplied by Okapi Migration Services. They apply with the product page, the applicable Consumer or Professional Licence, the Refunds and ACL Remedies policy and the Privacy Notice. If documents conflict, a non-excludable statutory right prevails. A digital-product purchase does not create a migration agent–client relationship or include personalised immigration assistance unless Okapi separately accepts an engagement under a distinct service agreement.
2. Products and order acceptance
Product pages identify the title, SKU, audience, inclusions, exclusions, formats, version, price, GST treatment, delivery method, support boundary, update entitlement and applicable licence before purchase. An order is an offer to buy the identified product version. Okapi accepts it only when payment is authorised and the system creates the matching purchaser entitlement. An acknowledgement is not acceptance while payment or eligibility checks remain pending. Okapi may reject or cancel an order before delivery for a pricing error, duplicate order, suspected fraud, unavailable or unapproved file, failed eligibility control or another reasonable operational or legal reason. Any amount taken for a cancelled undelivered order will be returned using the original method where practicable.
3. Price, currency and GST
Prices are in Australian dollars. Okapi is not registered for GST at this version date and does not add GST to these catalogue prices. Documents are described as an invoice or receipt, not a tax invoice, unless Okapi's GST position changes.
4. Payment and digital delivery
Payment is processed through the provider shown at checkout. Okapi does not promise delivery until payment is successfully authorised and the product is launch-eligible. After acceptance, the purchaser receives secure account access or another identified digital-delivery method for only the purchased product and version. No physical shipping is included. A failed, reversed or pending payment does not create an entitlement unless Okapi expressly authorises fulfilment. Okapi may suspend access where reasonably necessary to address fraud, security, copyright or legal risk, while preserving statutory remedies and purchased-version records.
5. Product use and licences
Use is governed by the licence identified on the product page and recorded at checkout. Copyright and other intellectual property remain with Okapi or the identified rights holder. The purchaser receives only the permissions expressly granted; ownership does not transfer. Purchasers must not resell, publish, redistribute, sublicense, share master or source files outside the permitted licence, remove rights notices, imply government endorsement or use the resource to create a competing commercial toolkit.
6. Migration information and professional responsibility
Resources provide general information, administrative tools or professional practice tools. They do not assess an individual's circumstances, eligibility, suitable visa, legislative criteria, prospects or strategy. Migration law, policy and procedure can change. Current official sources must be checked before reliance. Professional purchasers remain responsible for independent professional judgment, source checking, client obligations and regulatory compliance. Personalised analysis requires a separate engagement with a registered migration agent or another appropriately qualified professional.
7. Updates, corrections and withdrawal
The product page states the update entitlement. Unless expressly promised, purchase of one major version does not include future major versions. Okapi may provide corrections within the purchased major version. Okapi may stop new distribution or temporarily suspend access where reasonably necessary for material factual, legal, safety, copyright, privacy or security reasons. Where purchased access must be removed, Okapi will provide an appropriate corrected replacement or remedy as required by law.
8. Technical requirements and support
The purchaser is responsible for compatible software, devices, connectivity and backups stated on the product page. Okapi provides reasonable access and product-use support, but ordinary support does not include review of sensitive case documents or personalised immigration advice.
9. Consumer guarantees and remedies
Nothing in these terms excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded. If a product or service fails an applicable guarantee, the purchaser may be entitled to a repair, replacement, refund, cancellation or compensation depending on the circumstances. Any voluntary promise is additional to statutory rights. No generic 30-day money-back guarantee applies unless a product page expressly identifies that separate promise.
10. Liability
To the extent permitted by law, Okapi is not responsible for loss caused by use outside the stated purpose, failure to check current official sources, unauthorised alteration, incompatible systems or reliance on a resource as personalised advice. This does not exclude liability that cannot lawfully be excluded or limit rights to compensation for reasonably foreseeable loss under applicable law. No party is required to indemnify the other under these terms.
11. Complaints and disputes
Contact Okapi using the details above and identify the order, product, problem and requested outcome. Okapi will acknowledge the complaint and investigate in a reasonable time. The parties should attempt good-faith resolution. This does not prevent either party using a regulator, tribunal, court or other right available by law.
12. Changes and governing law
The terms version accepted for an order remains recorded. Okapi may update terms prospectively for future orders and will not retrospectively remove an accrued statutory or purchased right. Queensland law and applicable Commonwealth law govern, and the parties submit to courts and tribunals with jurisdiction without restricting statutory forum rights.
